Depuy Orthopaedics, Inc., announced that it will pay approximately 2.5 billion dollars to settle claims for individuals who were implanted with the recalled Depuy ASR™ XL Acetabular Hip System or the ASR™ Hip Resurfacing System and who had revision surgery to replace their ASR hip by August 31, 2013. The agreement was presented to state and federal judges presiding over litigation involving the recalled hip replacements at a hearing held yesterday. The Settlement does not include patients who have not yet had a revision or who have had a revision after August 31st of this year.

Eligible participants must register with the Settlement Program by January 6, 2014 and complete and submit all required documents, including medical records and documents supporting damages claimed, by April 1, 2014. The settlement provides a base award of $250,000 which can be supplemented or reduced based on certain patient-specific factors.

Of the approximately 12,000 DePuy ASR lawsuits currently pending in federal and state courts throughout the United States, it is estimated that approximately 8000 are on behalf of people who have had revision surgery on their defective hip implant. Depuy claims it will make most of the payments to eligible claimants in 2014.

The DePuy ASR Hip Implants were removed from the market in August of 2010 after reports indicated a very high failure rate. Internal Depuy and Johnson & Johnson documents uncovered during litigation showed that more than one-third of the implants were expected to fail within five years of their implantation. Hip implants are normally expected to last 10 to 20 years before revision is required.
