Takeda Pharmaceuticals, the maker of diabetes drug Actos (generic name pioglitazone), intentionally destroyed and deleted key documents that would have helped plaintiffs in their bladder cancer lawsuits pending against the company, according to the federal judge overseeing the litigation. Judge Rebecca Doherty ruled that Takeda destroyed relevant documents, intentionally deleted documents in bad faith with knowledge of its legal duty to preserve them, and the absence of those documents was and is prejudicial to plaintiffs.

Using the diabetes drug Actos for one year or more increases the risk of being diagnosed with bladder cancer by 39% according reports reviewed by the FDA in 2011. Even though the diabetes drug Actos (generic name: pioglitazone) has been taken off the market by the drug regulators of Germany, France, and India because of safety concerns, The Food and Drug Administration (FDA), despite issuing several safety communications about the drug, still allows Actos to be marketed in the United States. The FDA continues to evaluate the data.
The Thornton Law Firm asbestos trial team, led by Andrew Wainwright, has successfully settled the case of a retired plumber from Salem, New Hampshire. Our client was diagnosed with mesothelioma in 2013. Over the course of several days of deposition testimony, the client identified different manufacturers of asbestos-covered boilers and furnaces which he worked on during the 1960s and 1970s, exposing him to asbestos that went on the new boilers and furnaces. He also testified that he was exposed to asbestos on the old equipment that was being removed. Most of the defendants settled in the weeks leading up to trial.

The EPA has announced that it will take public comment about whether to require chemical companies to disclose the chemicals contained in fracking fluid used in the hydraulic fracturing process. The “advanced notice of proposed rulemaking” issued by the EPA would also require oil and gas companies to submit all health and safety studies on the fluid to the federal government. The proposed rulemaking was partly in response to a petition by Earthjustice asking that full health and safety information be released by hydraulic fracturing companies and their suppliers.
